We are all aware that the NEC was specifically designed to avoid disputes with all change to be evaluated promptly by either the Contractor or the Project Manager.

However, many project proceed in the old adversarial manner with the evaluation of Compensation Events either done in a partial manner, or simply not done at all by the parties leaving complex situations of culpability and inefficiency to be resolved.

At A. Lamb Associates we have developed and proven strategies for dealing with these situations.

We can advise on the following:

• Where the direct Costs only have been dealt with by the Project Manager with an understanding that a Claim will be considered later, then this Claim is rejected.
• Where the Project Manager does not accept a Quotation but makes an "on account" payment.
• Where the Project Manager makes payment against Compensation Events but does not agree to a change to the Date for Completion.
• Where the Quantum of an Event is in dispute.
• Rules on the evaluation of delay and disruption.
• Rules on the application of Prelim and additional administration charges.
• Programme requirements and methodologies including "Time Slice Analysis" and "As Built But For" programming to support additional Cost.

We can produce high quality persuasive documentation that can if necessary be used in Adjudication, Arbitration or Litigation.
